§ 72.01 PURPOSE.
This chapter is enacted to promote and protect the health, safety, and general welfare throughout the city by lessening congestion in the public rights‑of‑way and in the commercial and residential areas.

§ 72.02 DEFINITIONS.
For the purpose of this chapter, the following definitions apply unless the context clearly indicates or requires a different meaning.
DRIVEWAY. A path for cars leading from a street or road to a garage, house, or building.
HIGHWAY. Any public roads freely open to everyone.
LAW ENFORCEMENT PERSONNEL. Any peace officer, whether it be a local police officer of the city of the Sheriff’s Department or a state patrol officer.
PUBLIC POUND. A storage lot for the impoundment of vehicles as designated by the City Council.
RIGHT‑OF‑WAY. A strip of land upon which a public road or highway is constructed and which is constructed for the purpose of passage of persons, vehicles, or things.
ROAD. A way made for traveling between places.
SNOW EMERGENCY. When one inch or more of snow falls in a given area or period of time within the city.
STREET. A public road in a town or city which is a paved or unpaved thoroughfare.
VEHICLE. Any device or contrivance for carrying or conveying persons or objects, including house trailers, cars, trucks, motor vehicles, pickups, semis, motorized vehicles, trailers, and recreational vehicles.

§ 72.03 MANNER OF PARKING.
(A) Every vehicle parked upon any street with a curb shall be parked parallel to the curb and with the right side of the vehicle within 12 inches to the curb unless otherwise provided by this chapter. On other streets, the vehicles shall be parked to the right of the main traveled portion thereof and parallel thereto, and in such a manner as to not interfere with the free flow of traffic.
(B) Vehicles parked on the south side of the Community Center on the north side of Second Street NW shall be parked vertically to the curb.

§ 72.04 LIMITATION OF PARKING AREAS.
No person shall stop, stand, or park a vehicle, except: when necessary to avoid conflict with other traffic; when the vehicle is disabled upon any street; in compliance with the directions of police officer, traffic control device, temporary traffic control signs; or during snow emergency, any of the following places:
(A) On a sidewalk;
(B) In front of a public or private driveway;
(C) Within an intersection;
(D) Within 20 feet of a fire hydrant;
(E) On a crosswalk;
(F) Within 20 feet of a crosswalk at an intersection;
(G) Within 30 feet upon the approach of any flashing beacon, stop sign, or traffic control signal located at the side of a roadway;
(H) Between a safety zone and the adjacent curb or within 30 feet of points on the curb immediately opposite the ends of a safety zone, unless a different length is indicated by signs or markings;
(I) Within 30 feet of the driveway entrance to any fire station;
(J) Along the side or opposite any street excavation or obstruction;
(K) On the roadway side of any vehicle stopped or parked at the edge or curb of a street;
(L) Upon any bridge or elevated structure upon a highway; or
(M) At any place where temporary or permanent official signs of the city prohibits the stopping or the parking of vehicles.

§ 72.05 CAMPING RESTRICTIONS.
No person shall, for camping purposes, leave or park a house trailer on any street or right‑of‑way within the boundaries of the city without obtaining a permit from the City Clerk/Treasurer.

§ 72.06 DURATION OF PARKING.
No vehicle shall be parked upon any street or right‑of‑way within the city in any one place for a longer continuous period than 24 hours.

§ 72.07 RESIDENTIAL PARKING.
(A) No person shall place, park, permit to remain, store, or leave upon any premises, except in a completely enclosed building, any motor vehicle which does not have affixed thereto a valid, current motor vehicle license, or any portions thereof or parts therefrom when the motor vehicle portions thereof or parts therefrom are rusted, wrecked, partially dismantled, or in junk condition, or in any inoperative or abandoned condition. The owner of the motor vehicle, portions thereof or parts therefrom, and the owner and occupant of the premises upon which they are located shall be obligated to remove same to a duly licensed junkyard or other authorized place of deposit or storage.
(B) Off‑street parking in residential districts may occupy all or part of any required side or rear yard but shall not be located in the front yard, except in an established driveway.

§ 72.08 COMMERCIAL PARKING.
(A) Off‑street parking in the commercial or industrial districts of the city may occupy any required commercial yards except that parking shall be set back ten feet from any road right‑of‑way.
(B) No person shall place, park, permit to remain, store, or leave upon any premises, except in a completely enclosed building, any motor vehicle which does not have affixed thereto a valid, current motor vehicle license, or any portions thereof or parts therefrom, when the motor vehicle portions thereof, or parts therefrom are rusted, wrecked, partially dismantled, or in junk condition, or in any inoperative or abandoned condition. No vehicle shall remain on the commercial or industrial district areas for more than 30 days.

§ 72.09 VIOLATIONS.
Any parking in a manner not permitted by this chapter shall be prohibited. The City Council, Mayor, or law enforcement personnel may institute appropriate actions or proceedings to prevent, restrain, correct, or evade the violations or threatened violations. The impounding of a vehicle shall not prevent or preclude the institution and the prosecution of proceedings for violation of law, in the county court, district court, or elsewhere, which action may be brought against the owner or operator of the impounded vehicle.

§ 72.10 IMPOUNDMENT OF VEHICLES AND AUTHORITY TO REMOVE.
(A) (1) Any vehicle, wherever found within the city limits, and in violation of this chapter or state laws is hereby declared to be a nuisance.
(2) The same which is situated on the road, street, right‑of‑way, or on public property may be summarily abated by or under the direction or at the request of a police officer by removing and impounding the vehicle to a public pound, by means of towing or otherwise, and shall only be surrendered to the duly identified owner thereof, or the owner’s agent, upon the payment of the fees incurred in the removal and impoundment of the vehicle.
(B) (1) Any other vehicle not listed in division (A) above, wherever found within the city limits, and in violation of this chapter or state laws is hereby declared to be a nuisance.
(2) The same which is situated on the road, street, or right‑of‑way may be summarily abated by or under the direction or at the request of the City Council or its authorized agent by an ex parte order of the court for removing and impounding the vehicle to a public pound, by means of towing or otherwise, and shall only be surrendered to the duly identified owner thereof, or the owner’s agent, upon the payment of the fees incurred in the removal and impoundment of the vehicle.

§ 72.11 PROHIBITED PARKING BY TRUCK-TRACTORS AND SEMITRAILERS.
(A) Definitions. For the purpose of this chapter, the following definitions apply unless the context clearly indicates or requires a different meaning.
MOTOR VEHICLE. Every vehicle which is self-propelled and every vehicle which is propelled by electric power obtained from overhead trolley wires. MOTOR VEHICLE does not include an electric personal assistive mobility device or a vehicle moved solely by human power.
SEMI TRAILER. A vehicle of the trailer type so designed and used in conjunction with a truck‑tractor that a considerable part of its own weight or that of its load rests upon and is carried by the truck‑tractor and includes a trailer drawn by a truck‑tractor SEMI TRAILER combination.
TRUCK‑TRACTOR.
(a) A motor vehicle designed and used primarily for drawing other vehicles and not constructed to carry a load other than a part of the weight of the vehicle and load drawn; and
(b) A motor vehicle designed and used primarily for drawing other vehicles used exclusively for transporting motor vehicles or boats and capable of carrying motor vehicles or boats on its own structure.
VEHICLE. Every device in, upon, or by which any person or property is or may be transported or drawn upon a highway, excepting devices used exclusively upon stationary rails or tracks.
(B) Duration of parking on public right‑of‑way and public property. No vehicle, other than a truck‑tractor or semitrailer, shall be parked upon any street, right‑of‑way, or other public property within the city in any one place for a continuous period of more than 24 hours. A truck‑tractor or semitrailer may not be continuously parked upon any street, right‑of‑way, or public property for any time period in duration greater than necessary to than to make a pickup or delivery at an adjacent location.
(C) Parking exceptions. It is unlawful for a person to park or store a truck‑tractor or semitrailer on a property within the city zoned for residential purposes for a continuous period in excess of 14 days, unless:
(1) The parking or storage is necessary for storage or supply of construction material or demolition debris in conjunction with a construction project on the property; or
(2) It is otherwise permitted by interim use permit issued by the city in conjunction with a home business operated on the property.
(D) Parking restrictions. It shall be unlawful for any person to park or store a truck‑tractor or semitrailer on any commercially zoned property in the city for a period in excess of two weeks, other than for the duration of a bona fide pick-up or delivery to that property or with a legally permitted B-2 zoned business operated at that property.
